{"data":{"id":"us-il/760-ilcs-3-1012","jurisdiction":"us-il","citation":"760 ILCS 3/1012","heading":"Protection of person dealing with trustee.","body":"(a) A person other than a beneficiary or a beneficiary's representative under Article 3 acting in a representative capacity who in good faith assists a trustee, or who in good faith and for value deals with a trustee, without knowledge that the trustee is exceeding or improperly exercising the trustee's powers is protected from liability as if the trustee properly exercised the power.\n(b) A person other than a beneficiary or a beneficiary's representative under Article 3 acting in a representative capacity who in good faith deals with a trustee is not required to inquire into the extent of the trustee's powers or the propriety of their exercise.\n(c) A person, including a beneficiary, who in good faith delivers assets to a trustee need not ensure their proper application.\n(d) A person other than a beneficiary who in good faith assists a former trustee, or who in good faith and for value deals with a former trustee, without knowledge that the trusteeship has terminated is protected from liability as if the former trustee were still a trustee.\n(e) Comparable protective provisions of other laws relating to commercial transactions or transfer of securities by fiduciaries prevail over the protection provided by this Section.","path":["CHAPTER 760 TRUSTS AND FIDUCIARIES","Illinois Trust Code."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=4001\u0026ChapterID=61\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:44Z","sha256":"0995496f851f529aa4c3f6613eb22295fe5b3dccb2d5e9eb3bbdf7eab7bdfacd","source_id":"us-il","stale":false,"prev":"us-il/760-ilcs-3-1011","next":"us-il/760-ilcs-3-1013"},"notice":"GroundRules: Original legal text.
