{"data":{"id":"us-il/765-ilcs-1075-20","jurisdiction":"us-il","citation":"765 ILCS 1075/20","heading":"Enforcement of rights and remedies.","body":"(a) The rights and remedies set forth in this Act may be exercised and enforced by:\n(1) an individual or his or her authorized representative;\n(2) a person to whom the recognized rights have been transferred by written transfer under Section 15 of this Act; or\n(3) after the death of an individual who has not transferred the recognized rights by written transfer under this Act, any person or persons that possess an interest in those rights.\n(a-5) In addition to the enforcement of rights and remedies in subsection (a), the rights and remedies set forth in this Act may, in the case of an individual who is a recording artist, be enforced by:\n(1) the individual who is the recording artist; or\n(2) a person who has entered into a contract for the individual's exclusive personal services as a recording artist or who has entered into a contract for an exclusive license to distribute sound recordings that capture the recording artist's audio performances.\n(b) Each person described in paragraph (3) of subsection (a) shall make a proportional accounting to, and shall act at all times in good faith with respect to, any other person in whom the rights being enforced have vested.","path":["CHAPTER 765 PROPERTY","Right of Publicity Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=2241\u0026ChapterID=62\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:46Z","sha256":"5c2534bbbf133579c170f3113f4f0503299707cdbbec35c86b3a6234d93a6b74","source_id":"us-il","stale":false,"prev":"us-il/765-ilcs-1075-15","next":"us-il/765-ilcs-1075-25"},"notice":"GroundRules: Original legal text.
