{"data":{"id":"us-il/765-ilcs-1090-3","jurisdiction":"us-il","citation":"765 ILCS 1090/3","heading":"Notice and opportunity for hearing.","body":"(a) Except as otherwise provided in subsection (b), the court may issue an order under this Act only after notice and opportunity for a hearing appropriate in the circumstances.\n(b) The court may issue an order under this Act:\n(1) without prior notice if the circumstances require issuance of an order before notice is given;\n(2) after notice and without a prior hearing if the circumstances require issuance of an order before a hearing is held; or\n(3) after notice and without a hearing if no interested party timely requests a hearing.\n(c) In connection with any sale of receivership property under Section 16 of this Act, notice shall be provided to:\n(1) the owner and all other persons having an interest in the property that would be affected by the sale;\n(2) with respect to any sale of real property, nonrecord claimants, unknown necessary parties, and unknown owners by publication in accordance with Sections 2-206 and 2-207 of the Code of Civil Procedure; and\n(3) such other persons as the court directs.","path":["CHAPTER 765 PROPERTY","Illinois Receivership Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=4605\u0026ChapterID=62\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:46Z","sha256":"b74934d9c3a63cd23250775757d78f748641e9fe622363959bcc38b6e2f0e69b","source_id":"us-il","stale":false,"prev":"us-il/765-ilcs-1090-2","next":"us-il/765-ilcs-1090-4"},"notice":"GroundRules: Original legal text.
