{"data":{"id":"us-il/815-ilcs-616-35","jurisdiction":"us-il","citation":"815 ILCS 616/35","heading":"Noncompliance.","body":"(a) Any waiver by a consumer of any protection provided by or any right of the consumer under this Act:\n(1) shall be treated as void; and\n(2) may not be enforced by any federal or State court or any other person.\n(b) Any attempt by a person to obtain a waiver from a consumer of any protection provided by or any right or protection of the consumer or any obligation or requirement of the educational planning service provider under this Act is a violation of this Act.\n(c) Any contract for educational planning services that does not comply with the applicable provisions of this Act:\n(1) shall be treated as void; and\n(2) may not be enforced by any federal or State court or any other person.\nUpon notice of a void contract, a refund by the educational planning service provider to the consumer shall be made as provided under subsections (c), (d), (e), and (f) of Section 30 of this Act.","path":["CHAPTER 815 BUSINESS TRANSACTIONS","Educational Planning Services Consumer Protection Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=4208\u0026ChapterID=67\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:48Z","sha256":"b35c5738622ae3674ffc6c5f2f44d3d5b279987d359393d4058c259fc8d22395","source_id":"us-il","stale":false,"prev":"us-il/815-ilcs-616-30","next":"us-il/815-ilcs-616-40"},"notice":"GroundRules: Original legal text.
