(a) In addition to any other remedy available to the board under this article or at law, the board may, after notice and a hearing, assess a civil penalty under this section for any of the following:\n(1) Failure to timely pay compensation under an approved settlement agreement as required by IC 22-3-2-15(d).\n(2) Failure to post a notice required by IC 22-3-2-22.\n(3) Failure to comply with IC 22-3-3-7 or IC 22-3-7-16.\n(4) Failure to timely pay compensation for permanent partial impairment as required by IC 22-3-3-10.5(c).\n(5) Failure to timely pay a compensation award as required by IC 22-3-3-24(a).\n(6) Failure to file an injury record with the board as required by section 13 of this chapter or to file a report of a disablement by occupational disease as required by IC 22-3-7-37.\n(b) For the first violation of an offense listed in subsection (a), the board may assess a civil penalty not to exceed fifty dollars ($50).\n(c) For the second unrelated violation of the same offense listed in subsection (a), the board may assess a civil penalty not to exceed one hundred fifty dollars ($150).\n(d) For the third or subsequent unrelated violation of the same offense listed in subsection (a), the board may assess a civil penalty not to exceed three hundred dollars ($300).\n(e) Civil penalties collected under this section shall be deposited in the worker's compensation supplemental administrative fund established by IC 22-3-5-6.","path":["TITLE 22.
