Notwithstanding any other section of this chapter, a person who is damaged by a seller's failure to comply with this chapter or by a seller's breach of a contract may:\n(1) bring an action for recovery of his actual damage including attorney fees; and\n(2) bring an action against the bond required by section 3 of this chapter;\nto recover an amount equal to his actual damages.
