(a) Except as provided in subsection (b), if a local public question must be certified to an election board by law, that certification must occur no later than noon:\n(1) seventy-four (74) days before a primary election if the public question is to be placed on the primary or municipal primary election ballot; or\n(2) August 1 if the public question is to be placed on the general or municipal election ballot.\n(b) A referendum or local public question:\n(1) under IC 20-46-1;\n(2) under IC 20-46-9; or\n(3) under IC 6-1.1-20 for controlled projects;\nmay be placed on the ballot only at a general election.
