(a) The county chairman of each major political party of the county may appoint one (1) person to observe:\n(1) the ordering and the setting and adjustment of automatic tabulating machines under section 6 of this chapter;\n(2) the testing of automatic tabulating machines under section 22 of this chapter; and\n(3) the determination of the cause of and correction of errors in the counting of ballot cards under section 25 of this chapter.\n(b) The county chairman shall file the name of a person appointed under this section with the circuit court clerk.\n(c) A person appointed under this section serves until:\n(1) the county chairman notifies the circuit court clerk that the person's appointment has been revoked;\n(2) the county chairman notifies the clerk that the person has died; or\n(3) the person files a letter of resignation with the clerk.\n(d) A person appointed under subsection (a):\n(1) may attend the ordering and the setting and the adjustment of the automatic tabulating machines only as a witness;\n(2) shall remain silent and subject to the orders of the board; and\n(3) may not obstruct or interfere with the ordering and setting and adjustment of the automatic tabulating machines.\n(e) A person appointed under subsection (a) is not entitled to compensation for services except from the political party of the county chairman making the appointment.","path":["TITLE 3.
