A person employed, appointed, or under contract with a state agency, who works with or around children, shall be dismissed (after the appropriate pre-deprivation procedure has occurred) if that person is, or has ever been, convicted of any of the following:\n(1) Rape (IC 35-42-4-1), if the victim is less than eighteen (18) years of age.\n(2) Criminal deviate conduct (IC 35-42-4-2) (before its repeal), if the victim is less than eighteen (18) years of age.\n(3) Child molesting (IC 35-42-4-3).\n(4) Child exploitation (IC 35-42-4-4).\n(5) Vicarious sexual gratification (IC 35-42-4-5).\n(6) Child solicitation (IC 35-42-4-6).\n(7) Child seduction (IC 35-42-4-7).\n(8) Sexual misconduct with a minor (IC 35-42-4-9) as a Class A or Class B felony (for a crime committed before July 1, 2014) or a Level 1, Level 2, or Level 4 felony (for a crime committed after June 30, 2014).\n(9) Incest (IC 35-46-1-3), if the victim is less than eighteen (18) years of age.","path":["TITLE 4.
