A mediator may not be selected to mediate a proceeding if the mediator:\n(1) has an interest in the outcome of the proceeding;\n(2) is related to any of the parties or attorneys in the proceeding; or\n(3) is employed by any of the parties or attorneys involved in the proceeding, except that an employee of the agency involved may serve as a mediator if the employee of the agency:\n(A) has not participated in the investigation or prosecution of the dispute; and\n(B) does not otherwise have an interest in the outcome of the proceeding.","path":["TITLE 4.
