(a) As used in this chapter, \"energy production zone\" means a premise of land on which any of the following was located as of January 1, 2025:\n(1) An electric generation facility with a generating capacity of at least eighty (80) megawatts, regardless of whether the electric generation facility is operational.\n(2) A surface or underground mine at which mining operations are no longer occurring.\n(b) The term does not include a premise of land on which either of the following was located as of January 1, 2025:\n(1) One (1) or more wind power devices (as defined in IC 8-1-41-7) that are integrated into an electric generation facility.\n(2) One (1) or more commercial solar energy systems (as defined in IC 8-1-42-2).","path":["TITLE 8.
