{"data":{"id":"us-in/ic-9-13-2-43","jurisdiction":"us-in","citation":"IC 9-13-2-43","heading":"\"Designated family member\"","body":"Sec. 43. (a) \"Designated family member\", except as provided in subsection (b), means the following:\n(1) A franchisee's spouse, child, grandchild, parent, or sibling who has been nominated as the franchisee's successor under a written document filed by the franchisee with the franchisor.\n(2) If no such document has been filed, the term means a franchisee's spouse, child, grandchild, parent, or sibling who:\n(A) if the franchisee is deceased, is entitled to inherit the franchisee's ownership interest in the franchisee's business under the franchisee's will or under the laws of intestate succession; or\n(B) if the franchisee is incapacitated, is appointed by the court as the legal representative of the franchisee's property.\n(3) If a franchisee is deceased, the term includes the appointed and qualified personal representative and testamentary trustee of the deceased franchisee.\n(b) \"Designated family member\", for purposes of IC 9-32-19, has the meaning set forth in IC 9-32-19-5.","path":["TITLE 9.
