{"data":{"id":"us-ks/k.s.a.-21-5432","jurisdiction":"us-ks","citation":"K.S.A. 21-5432","heading":"Human smuggling; aggravated human smuggling.","body":"(a) (1) Human smuggling is intentionally transporting, harboring or concealing an individual into or within Kansas when the person:\n(A) Knows, or should have known, that the individual is entering into or remaining in the United States illegally;\n(B) benefits financially or receives anything of value; and\n(C) knows, or should have known, that the individual being smuggled is likely to be exploited for the financial gain of another.\n(2) Aggravated human smuggling is human smuggling that:\n(A) Is committed using a deadly weapon or by threat of use of a deadly weapon;\n(B) causes bodily harm, great bodily harm or disfigurement to the individual being smuggled; or\n(C) causes the individual being smuggled to become a victim of a sex offense described in article 55 of chapter 21 of the Kansas Statutes Annotated, and amendments thereto, or human trafficking as defined in K.S.A. 21-5426, and amendments thereto, or causes the person to commit selling sexual relations as defined in K.S.A. 21-6419, and amendments thereto.\n(b) (1) Human smuggling is a severity level 5, person felony; and\n(2) aggravated human smuggling is a severity level 3, person felony.\n(c) This section shall be a part of and supplemental to the Kansas criminal code.","path":["Chapter 21.—CRIMES AND PUNISHMENTS","Article 54.—CRIMES AGAINST PERSONS"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch21/021_054_0032.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-09-04T15:11:10Z","sha256":"2bd1c5290f86b3c82c74ff4e0de4cd078db3b417ef4595b3d65806c0dad2f64a","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-21-5431","next":"us-ks/k.s.a.-21-5433"},"notice":"GroundRules: Original legal text.
