{"data":{"id":"us-ks/k.s.a.-21-5802","jurisdiction":"us-ks","citation":"K.S.A. 21-5802","heading":"Theft of property lost, mislaid or delivered by mistake.","body":"(a) Theft of property lost, mislaid or delivered by mistake is obtaining control of property of another by a person who:\n(1) Knows or learns the identity of the owner thereof;\n(2) fails to take reasonable measures to restore to the owner lost property, mislaid property or property delivered by a mistake; and\n(3) intends to permanently deprive the owner of the possession, use or benefit of the property.\n(b) Theft of property lost, mislaid or delivered by mistake of the value of:\n(1) $100,000 or more is a severity level 5, nonperson felony;\n(2) at least $25,000 but less than $100,000 is a severity level 7, nonperson felony;\n(3) at least $1,000 but less than $25,000 is a severity level 9, nonperson felony; and\n(4) less than $1,000 is a class A nonperson misdemeanor.\n(c) As used in this section, \"property delivered by mistake\" includes, but is not limited to, a mistake as to the:\n(1) Nature or amount of the property; or\n(2) identity of the recipient of the property.","path":["Chapter 21.—CRIMES AND PUNISHMENTS","Article 58.—CRIMES INVOLVING PROPERTY"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch21/021_058_0002.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-09-04T15:11:11Z","sha256":"adafb0d2f9b2fec354889d85a7867e62006cc298ddd0e998ab1444951e6d3c47","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-21-5801","next":"us-ks/k.s.a.-21-5803"},"notice":"GroundRules: Original legal text.
