(a) In a case arising under this act or involving the Hague Convention on the civil aspects of international child abduction, the prosecutor may take any lawful action, including resort to a proceeding under K.S.A. 23-37,301 through 23-37,317, and amendments thereto, or any other available civil proceeding to locate a child, obtain the return of a child, or enforce a child-custody determination if there is:\n(1) An existing child-custody determination;\n(2) a request to do so from a court in a pending child-custody proceeding;\n(3) a reasonable belief that a criminal statute has been violated; or\n(4) a reasonable belief that the child has been wrongfully removed or retained in violation of the Hague Convention on the civil aspects of international child abduction.\n(b) A prosecutor acting under this section acts on behalf of the court and may not represent any party.","path":["Chapter 23.—KANSAS FAMILY LAW CODE-REVISED","Article 37.—UNIFORM CHILD-CUSTODY JURISDICTION AND ENFORCEMENT ACT (UCCJEA)"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch23/023_037_0315.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-09-04T15:11:22Z","sha256":"ed988356e3389acd268dd331e16d571c219b28f1dc5dd4ff114b9e9eaa2f263c","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-23-37-314","next":"us-ks/k.s.a.-23-37-316"},"notice":"GroundRules: Original legal text.
