{"data":{"id":"us-ks/k.s.a.-38-1707","jurisdiction":"us-ks","citation":"K.S.A. 38-1707","heading":"Transfer in absence of will or trust.","body":"(a) Subject to subsection (c), a personal representative or trustee may make an irrevocable transfer to another adult or trust company as custodian for the benefit of a minor pursuant to K.S.A. 38-1710, and amendments thereto, in the absence of a will or under a will or trust that does not contain an authorization to do so.\n(b) Subject to subsection (c), a conservator may make an irrevocable transfer to another adult or trust company as custodian for the benefit of the minor pursuant to K.S.A. 38-1710, and amendments thereto.\n(c) A transfer under subsection (a) or (b) may be made only if:\n(1) The personal representative, trustee or conservator considers the transfer to be in the best interest of the minor;\n(2) the transfer is not prohibited by or inconsistent with provisions of the applicable will, trust agreement or other governing instrument; and\n(3) the transfer is authorized by the court if such transfer exceeds $25,000 in value.","path":["Chapter 38.—MINORS","Article 17.—UNIFORM TRANSFERS TO MINORS ACT"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch38/038_017_0007.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-09-04T15:11:45Z","sha256":"c81cecc239f6cfc7dd0e2abde802b2bcb9d9b318dfaf06036fa8659fecda4473","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-38-1706","next":"us-ks/k.s.a.-38-1708"},"notice":"GroundRules: Original legal text.
