{"data":{"id":"us-ks/k.s.a.-48-3070","jurisdiction":"us-ks","citation":"K.S.A. 48-3070","heading":"(KCMJ Art. 132) Retaliation.","body":"(a) Any person subject to this code shall be punished at the direction of a commanding officer if such person takes or threatens to take an adverse personnel action or withholds or threatens to withhold a favorable personnel action with the intent to:\n(1) Retaliate against any person for reporting or planning to report a criminal or military offense;\n(2) retaliate against any person making or planning to make a protected communication; or\n(3) discourage any person from reporting or planning to report a criminal or military offense.\n(b) As used in this section:\n(1) \"Covered individual or organization\" means any recipient of communication specified in 10 U.S.C. § 1034(b)(1)(B)(i) through (v).\n(2) \"Inspector general\" means the same as defined in 10 U.S.C. § 1034(j).\n(3) \"Protected communication\" means:\n(A) A lawful communication to a member of congress or an inspector general; or\n(B) a communication to a covered individual or organization in which a member of the armed forces or state military forces complains of or discloses information that the member reasonably believes constitutes evidence of the following:\n(i) A violation of law or regulation prohibiting sexual harassment or unlawful discrimination; or\n(ii) gross mismanagement, a gross waste of funds, an abuse of authority or a substantial and specific danger to public health or safety.\n(4) \"Unlawful discrimination\" means discrimination on the basis of race, color, religion, sex or national origin.","path":["Chapter 48.—MILITIA, DEFENSE AND PUBLIC SAFETY","Article 30.—CODE OF MILITARY JUSTICE; PUNITIVE SECTIONS"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch48/048_030_0070.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-10-15T06:18:16Z","sha256":"56e616e9cca44417838e561192d00ca5907bd29576396061b84332482de4ca8f","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-48-3069","next":"us-ks/k.s.a.-48-3101"},"notice":"GroundRules: Original legal text.
