{"data":{"id":"us-ks/k.s.a.-51-301","jurisdiction":"us-ks","citation":"K.S.A. 51-301","heading":"Unlawful use of a recording device.","body":"(a) Unlawful use of a recording device is knowingly operating, in a motion picture theater, while a motion picture is being exhibited, an audiovisual recording function of a device without the consent of the owner or lessee of such theater.\n(b) Unlawful use of a recording device is a class A nonperson misdemeanor on conviction of the first offense. Unlawful use of a recording device is a severity level 9, nonperson felony on conviction of a second or subsequent conviction.\n(c) This section shall not apply to a person operating an audiovisual recording device as part of such person's lawfully authorized investigative, law enforcement, protective or intelligence gathering duties as a lawfully authorized investigative, law enforcement, protective or intelligence gathering employee or agent of the state or federal government.\n(d) As used in this section:\n(1) \"Audiovisual recording function\" means the capability of a device to record or transmit a motion picture or any part thereof by means of any technology now known or later developed.\n(2) \"Motion picture theater\" means a movie theater, screening room or other venue when used primarily for the exhibition of a motion picture.","path":["Chapter 51.—MOTION PICTURES","Article 3.—UNLAWFUL RECORDING"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch51/051_003_0001.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-10-15T06:19:01Z","sha256":"01631cd024bef7ab641a2ee94be7e315b36d6aaa9e577378b817c04c212de09c","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-51-203","next":"us-ks/k.s.a.-51-302"},"notice":"GroundRules: Original legal text.
