{"data":{"id":"us-ks/k.s.a.-65-67a01","jurisdiction":"us-ks","citation":"K.S.A. 65-67a01","heading":"Fetal organs or tissue; definitions.","body":"As used in this act:\n(a) \"Abortion\" means an abortion as defined by K.S.A. 65-6701, and amendments thereto.\n(b) (1) \"Consideration\" means:\n(A) Any payment made or debt incurred;\n(B) any gift, honorarium or recognition of value bestowed;\n(C) any price, charge or fee which is waived, forgiven, reduced or indefinitely delayed;\n(D) any loan or debt which is canceled or otherwise forgiven; or\n(E) the transfer of any item from one person to another or provision of any service or granting of any opportunity for which a charge is customarily made, without charge or for a reduced charge.\n(2) \"Consideration\" shall not mean:\n(A) A payment in an amount not to exceed $25 for the cost of transporting, processing, preserving and storing fetal tissue; or\n(B) a payment in an amount not to exceed the actual cost, as documented by the delivery service, of transporting fetal tissue.\n(c) \"Delivery service\" means a common carrier as defined by K.S.A. 66-105, and amendments thereto, or other person or entity used to transport fetal tissue.\n(d) \"Fetal tissue\" means any tissue, cells or organs obtained from a dead human embryo or fetus after an abortion or after a stillbirth.\n(e) \"Person\" means a person as defined by K.S.A. 65-425, and amendments thereto.\n(f) \"Stillbirth\" means a stillbirth as defined by K.S.A. 65-2401, and amendments thereto.","path":["Chapter 65.—PUBLIC HEALTH","Article 67a.—FETAL ORGANS AND TISSUE"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch65/065_067a_0001.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-10-15T06:25:01Z","sha256":"b79f438ec7d3f2fd5c61d5e542dfb6e7b72ccb9e6f1b9264c95ee5e0b7e6a7fc","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-65-6759","next":"us-ks/k.s.a.-65-67a02"},"notice":"GroundRules: Original legal text.
