{"data":{"id":"us-ks/k.s.a.-72-3127","jurisdiction":"us-ks","citation":"K.S.A. 72-3127","heading":"Definitions.","body":"As used in K.S.A. 72-3122 through 72-3125, and amendments thereto, and K.S.A. 2025 Supp. 72-3126 and 72-3128, and amendments thereto:\n(a) \"Homeless child\" means a child who lacks a fixed, regular and adequate nighttime residence and whose primary nighttime residence is:\n(1) A supervised publicly or privately operated shelter designed to provide temporary living accommodations, including welfare hotels, congregate shelters and transitional housing for the mentally ill;\n(2) an institution that provides a temporary residence for individuals intended to be institutionalized; or\n(3) a public or private place not designed for, or ordinarily used as, a regular sleeping accommodation for humans.\n(b) \"Nonresident student\" means a child of school age pursuant to K.S.A. 72-3118, and amendments thereto, who resides in Kansas and is enrolled and in attendance at or seeking to enroll and attend a school located in a school district where such student is not a resident.\n(c) \"Parent\" means and includes natural parents, adoptive parents, stepparents and foster parents.\n(d) \"Person acting as parent\" means:\n(1) A guardian or conservator; or\n(2) a person, other than a parent, who:\n(A) Is liable by law to maintain, care for or support the child;\n(B) has actual care and control of the child and is contributing the major portion of the cost of support of the child;\n(C) has actual care and control of the child with the written consent of a person who has legal custody of the child; or\n(D) has been granted custody of the child by a court of competent jurisdiction.\n(e) \"Receiving school district\" means a school district of nonresidence of a student who attends school in such school district.\n(f) \"School district\" means a school district organized and operating under the laws of this state.\n(g) \"Sending school district\" means a school district of residence of a student who attends school in a school district not of the student's residence.\n(h) \"Sibling\" means a brother or sister of the whole or half blood, adoptive brother or sister, a stepbrother or stepsister or a foster brother or foster sister.","path":["Chapter 72.—SCHOOLS","Article 31.—SCHOOL ATTENDANCE"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch72/072_031_0027.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-10-15T06:28:01Z","sha256":"6f323a62c17c030132ae7bd52ed81403ed9fa92990e690dd01acae4da8459639","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-72-3126","next":"us-ks/k.s.a.-72-3128"},"notice":"GroundRules: Original legal text.
