{"data":{"id":"us-ks/k.s.a.-75-726","jurisdiction":"us-ks","citation":"K.S.A. 75-726","heading":"Access to records by the attorney general.","body":"(a) The attorney general shall be allowed access to all records held by a provider:\n(1) That are directly related to an alleged violation of K.S.A. 2025 Supp. 21-5926 through 21-5934, 75-725 and 75-726, and amendments thereto, and which are necessary for the purpose of investigating whether any person may have violated such statutes; or\n(2) for use or potential use in any legal, administrative or judicial proceeding pursuant to K.S.A. 2025 Supp. 21-5926 through 21-5934, 75-725 and 75-726, and amendments thereto.\n(b) No person holding such records may refuse to provide the attorney general with access to such records on the basis that release would violate any:\n(1) Recipient's right of privacy;\n(2) recipient's privilege against disclosure or use; or\n(3) professional or other privilege or right.\n(c) The disclosure of patient information as required by K.S.A. 2025 Supp. 21-5926 through 21-5934, 75-725 and 75-726, and amendments thereto, shall not subject any provider to liability for breach of any confidential relationship between a patient and a provider.\n(d) Notwithstanding K.S.A. 60-427, and amendments thereto, there shall be no privilege preventing the furnishing of such information or reports as required by K.S.A. 2025 Supp. 21-5926 through 21-5934, 75-725 and 75-726, and amendments thereto, by any person.","path":["Chapter 75.—STATE DEPARTMENTS; PUBLIC OFFICERS AND EMPLOYEES","Article 7.—ATTORNEY GENERAL"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch75/075_007_0026.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-09-04T15:14:32Z","sha256":"5ba736d60870ade14c4344507e0459c64626513a5278d67c29858eb4285907ae","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-75-725","next":"us-ks/k.s.a.-75-727"},"notice":"GroundRules: Original legal text.
