{"data":{"id":"us-ks/k.s.a.-8-2-136","jurisdiction":"us-ks","citation":"K.S.A. 8-2,136","heading":"Same; prohibiting driving with alcohol in person's system; out-of-service order.","body":"(a) Notwithstanding any other provisions of this act, a driver shall not drive, operate or be in physical control of a commercial motor vehicle while having alcohol in such driver's system.\n(b) A driver who drives, operates or is in physical control of a commercial motor vehicle while having alcohol in such driver's system or who refuses to take a test to determine their alcohol content as provided by K.S.A. 8-2,142, and amendments thereto, shall be placed out-of-service for 24 hours.\n(c) A driver convicted of violating an out-of-service order while driving or operating a commercial motor vehicle shall be subject to the following disqualifications:\n(1) First conviction, the driver is disqualified for 90 days;\n(2) second conviction, the driver is disqualified for one year;\n(3) third and subsequent conviction, the driver is disqualified for three years.","path":["Chapter 8.—AUTOMOBILES AND OTHER VEHICLES","Article 2.—DRIVERS' LICENSES"],"source_url":"https://www.ksrevisor.gov/statutes/chapters/ch08/008_002_0136.html","current_through":"2025 legislative session","vintage":"","retrieved_at":"2026-09-04T15:09:55Z","sha256":"2839cdc5c1b4e35ffda8b29bf4c0fd099fe293a00457ca50e4742e3619700fdc","source_id":"us-ks","stale":false,"prev":"us-ks/k.s.a.-8-2-135","next":"us-ks/k.s.a.-8-2-137"},"notice":"GroundRules: Original legal text.
