{"data":{"id":"us-ky/kre-410","jurisdiction":"us-ky","citation":"KRE 410","heading":"Inadmissibility of pleas, plea discussions, and related statements","body":"Except as otherwise provided in this rule, evidence of the following is not, in any civil or\ncriminal proceeding, admissible against the defendant who made the plea or was a\nparticipant in the plea discussions:\n(1) A plea of guilty which was later withdrawn;\n(2) A plea of nolo contendere in a jurisdiction accepting such pleas;\n(3) Any statement made in the course of formal plea proceedings, under either state\nprocedures or Rule 11 of the Federal Rules of Criminal Procedure, regarding either\nof the foregoing pleas; or\n(4) Any statement made in the course of plea discussions with an attorney for the\nprosecuting authority which do not result in a plea of guilty or which result in a plea\nof guilty later withdrawn.\nHowever, such a plea or statement is admissible (i) in any proceeding wherein another\nstatement made in the course of the same plea or plea discussions has been introduced\nand the statement ought in fairness be considered contemporaneously with it, or (ii) in a\ncriminal proceeding for perjury or false s tatement if the statement was made by the\ndefendant under oath, on the record and in the presence of counsel.","path":["KENTUCKY RULES OF EVIDENCE ----- Legislative Research Commission Note (7/1/92).
