{"data":{"id":"us-ky/krs-100.157","jurisdiction":"us-ky","citation":"KRS 100.157","heading":"Removal -- Effect of compact -- Membership upon establishment of","body":"consolidated local government.\n(1) Any member of a planning commission may be removed by the appropriate\nappointing authority for inefficiency, neglect of duty, malfeasance, or conflict of\ninterest. Any appointing authority who exercises the power to remove a member of\nthe planning commission shall submit a written statement to the commission setting\nforth the reasons for removal, and the statement shall be read at the next meeting of\nthe planning commission, which shall be open to the general public. The member so\nremoved shall have the right of appeal in the Circuit Court.\n(2) Notwithstanding subsection (1) of this section, and KRS 100.143, when a city of the\nfirst class and a county con taining such city have in effect a compact pursuant to\nKRS 79.310 to 79.330, the terms of the appointed members on the commission\nshall be for three (3) years and until their successors are appointed and qualified.\nUpon the effective date of the compact, the mayor, and county judge/executive with\nthe approval of the fiscal court, shall adjust the terms of the sitting members so that\nthe terms of one (1) of each of their appointments expire in one (1) year, the term of\none (1) of each of their appointments expire in two (2) years and the term of one (1)\nof each of their appointments expire in three (3) years. Upon expiration of these\nstaggered terms, successors shall be appointed for a term of three (3) years.\n(3) Notwithstanding subsections (1) and (2) of this section, and KRS 100.143, upon the\nestablishment of a consolidated local government in a county where a city of the\nfirst class and a county containing that city have had in effect a cooperative compact\npursuant to KRS 79.310 to 79.330, the terms of the  appointed citizen members of\nthe planning commission shall be for three (3) years and until their successors are\nappointed and qualified, and the term of office of members appointed shall be\nstaggered. Members appointed to the planning commission prior to consolidation of\na city of the first class and the county containing the city pursuant to KRS Chapter\n67C shall continue to serve as members of the planning commission for the\nconsolidated local government, and shall serve the remainder of the terms for which\nthe members were appointed and until their successors are appointed and qualified\npursuant to KRS 100.137(2).","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26698","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:03Z","sha256":"64acc72bdd85276e3e741018e16aac533b9593d57ace46e48f6772adc1540341","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.153","next":"us-ky/krs-100.160"},"notice":"GroundRules: Original legal text.
