{"data":{"id":"us-ky/krs-100.171","jurisdiction":"us-ky","citation":"KRS 100.171","heading":"Quorum -- Member may conduct hearing or preside.","body":"(1) A simple majority of the total membership of a planning commission as established\nby agreement shall constitute a quorum, except that a planning unit created pursuant\nto KRS 100.137 may specify in its planning agreement that five (5) members of the\nplanning commission shall constitute a quorum. Any member of a planning\ncommission who has any direct or indirect financial interest in the outcome of any\nquestion before the body shall disclose the nature of the interest and shall disqualify\nhimself from voting on the question, and he shall not be counted for the purpose of\na quorum. A simple majority vote of all members present where there is a properly\nconstituted quorum shall be necessary to transact any business of the commission,\nexcept that a vote of a simp le majority of the total membership shall be necessary\nfor the adoption or amendment of the comprehensive plan.\n(2) A planning commission may appoint one (1) or more of its members to act as a\nhearing examiner or examiners to preside over a public hearing and make\nrecommendations to the commission based upon a transcript of record of the\nhearing.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26704","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:04Z","sha256":"b5a9649d0deea7ecd36264c308872a9556ba2233fbef16fecd9a812f381709ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.170","next":"us-ky/krs-100.173"},"notice":"GroundRules: Original legal text.
