{"data":{"id":"us-ky/krs-100.2101","jurisdiction":"us-ky","citation":"KRS 100.2101","heading":"Density development projects in county containing consolidated local","body":"government -- Restrictions -- Definitions.\n(1) As used in this section, unless the context otherwise requires:\n(a) \"Accessory dwelling unit\" means a smaller, secondary dwel ling unit located\non the same lot as a principal dwelling, which provides complete, independent\nliving facilities;\n(b) \"Density development project\" means any proposed residential development\nproject that:\n1. Contains multifamily housing; and\n2. If approved would result in an increase in:\na. Fire department or emergency medical service response times for\ncurrent residents in the vicinity of the project; or\nb. Traffic and congestion on roads accessing the development that\nwould reduce the level of service on  the most adjacent arterial,\ncollector, or access road a full letter grade, or reduce level of\nservice below grade D on those roads;\n(c) \"Level of service\" means a qualitative measurement of traffic conditions\ngraded on an A to F scale as set out in the Hi ghway Capacity Manual as\npublished by the Transportation Research Board;\n(d) \"Multifamily housing\" means any residential housing type other than single -\nfamily homes and accessory dwelling units; and\n(e) \"Traditional single -family home zone\" means a zone that, as of January 1,\n2025, did not include multifamily homes as a permitted use.\n(2) In a county containing a consolidated local government, any density development\nproject that is proposed in a traditional single -family home zone shall be treated as\nif it were an amendment to the zoning map, and shall be subject to the procedures\nset forth in KRS 100.211, 100.2111, 100.212, 100.213, and 100.214, including\napproval by the legislative body, except a planning unit shall not use the alternative\nregulation for zoning map amendment under KRS 100.2111 when considering a\ndensity development project.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56173","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:04Z","sha256":"3c9b121c9ee066a67efcc80fc5fc70d1227db2e33779229b5836ffbc21d8e626","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.210","next":"us-ky/krs-100.211"},"notice":"GroundRules: Original legal text.
