{"data":{"id":"us-ky/krs-100.212","jurisdiction":"us-ky","citation":"KRS 100.212","heading":"Notice of hearing on proposed map amendment.","body":"When in any planning unit except for a planning unit containing a city of the first class or\na consolidated local government, a hearing is scheduled on a proposal by a property\nowner to amend any zoning map, the following notice shall be given in addition to any\nother notice required by statute, local regulation, or ordinance:\n(1) Notice of the hearing shall be posted conspicuously on the property the\nclassification of which is proposed to be changed for fourteen (14) consecutive days\nimmediately prior to the hearing. Posting shall be as follows:\n(a) The sign shall state \"zoning change\" and the proposed classification change in\nletters three (3) inches in height. The time, place, and date of hearing shall be\nin letters at least one (1) inch in height; and\n(b) The sign shall be constructed of durable material and shall state the telephone\nnumber of the appropriate zoning commission; and\n(2) Notice of the hearing shall be given at least fourteen (14) days in advance of the\nhearing by first -class mail, with cert ification by the commission secretary or other\nofficer of the planning commission that the notice was mailed to an owner of every\nparcel of property adjoining the property the classification of which is proposed to\nbe changed. It shall be the duty of the p erson or persons proposing the map\namendment to furnish to the planning commission the names and addresses of the\nowners of all adjoining property. Records maintained by the property valuation\nadministrator may be relied upon conclusively to determine the identity and address\nof the owner. If the property is in condominium or cooperative forms of ownership,\nthe person notified by mail shall be the president or chairman of the owner group\nwhich administers property commonly owned by the condominium or cooper ative\nowners. A joint notice may be mailed to two (2) or more co -owners of an adjoining\nproperty who are listed in the property valuation administrator's records as having\nthe same address.\n(3) If the property the classification of which is proposed to be changed adjoins\nproperty in a different planning unit, or property which is not part of any planning\nunit, notice of the hearing shall be given at least fourteen (14) days in advance of\nthe hearing, by first-class mail to certain public officials, as follows:\n(a) If the adjoining property is part of a planning unit, notice shall be given to that\nunit's planning commission; or\n(b) If the adjoining property is not part of a planning unit, notice shall be given to\nthe mayor of the city in which the property is  located or, if the property is in\nan unincorporated area, notice shall be given to the judge/executive of the\ncounty in which the property is located.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26728","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:04Z","sha256":"d7848267a6a265e0af3d0cd8884e60f7857c8bdadecd980041a86361e54b1ba7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.2111","next":"us-ky/krs-100.213"},"notice":"GroundRules: Original legal text.
