{"data":{"id":"us-ky/krs-100.243","jurisdiction":"us-ky","citation":"KRS 100.243","heading":"Findings necessary for granting variances.","body":"(1) Before any variance is granted, the board must find that the granting of the variance\nwill not adversely affect the public health, safety or welfare, will not alter the\nessential character of the general vicinity, will not cause a hazard or a nuisance to\nthe public, and will not allow an unreasonable circumvention of the requirements of\nthe zoning regulations. In making these findings, the board shall consider whether:\n(a) The requested variance arises from special circumstances which do not\ngenerally apply to land in the general vicinity, or in the same zone;\n(b) The strict application of the provisions of the regulation would deprive the\napplicant of the reasonable use of the land or would create an unnecessary\nhardship on the applicant; and\n(c) The circumstances are the result of actions of the applicant taken subsequent\nto the adoption of the zoning regulation from which relief is sought.\n(2) The board shall deny any request for a variance arising from circumstances that are\nthe result of willful violatio ns of the zoning regulation by the applicant subsequent\nto the adoption of the zoning regulation from which relief is sought.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26744","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:04Z","sha256":"bac9274d61f38c7a9f2141b79b4a975c2343d58e3b65dfbf35457234d9f7b239","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.241","next":"us-ky/krs-100.247"},"notice":"GroundRules: Original legal text.
