{"data":{"id":"us-ky/krs-100.275","jurisdiction":"us-ky","citation":"KRS 100.275","heading":"Subdivision plats and development plans -- Local ordinances, rules, and","body":"regulations -- Requirements.\n(1) Except as provided in subsection (2) of this section, the ordinances, rules, and\nregulations adopted pursuant to this chapter gover ning subdivision plats and\ndevelopment plans shall be in the form of objective standards that shall be applied\nministerially.\n(2) Ordinances, rules, and regulations governing development plans may allow for\ndiscretion to be applied by the approving authority in circumstances where:\n(a) An applicant seeks a deviation from the established objective standards; or\n(b) The approving authority determines, based on substantial evidence, that a\nstrict ministerial application of the established objective standards w ould pose\na specific threat to public health, safety, or welfare in the affected area.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55805","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:04Z","sha256":"7cec0f900ef4e06ce9aed9b099771726625e0a4eb78ab4562b646ca7add9adf5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.273","next":"us-ky/krs-100.277"},"notice":"GroundRules: Original legal text.
