{"data":{"id":"us-ky/krs-100.277","jurisdiction":"us-ky","citation":"KRS 100.277","heading":"Commission approval required for subdivisions.","body":"(1) All subdivision of land shall receive commission approval.\n(2) No person or his agent shall subdivide any land before securing the approval of the\nplanning commission of a plat designating the areas to be subdivided, and no plat of\na subdivision of land wi thin the planning unit jurisdiction shall be recorded by the\ncounty clerk until the plat has been approved by the commission and the approval\nentered thereon in writing by the chairman, secretary, or other duly authorized\nofficer of the commission.\n(3) No person owning land composing a subdivision, or his agent, shall transfer or sell\nany lot or parcel of land located within a subdivision by reference to, or by\nexhibition, or by any other use of a plat of such subdivision, before such plat has\nreceived fina l approval of the planning commission and has been recorded. Any\nsuch instrument of transfer or sale shall be void and shall not be subject to be\nrecorded unless the subdivision plat subsequently receives final approval of the\nplanning commission, but all rights of such purchaser to damages are hereby\npreserved. The description of such lot or parcel by metes and bounds in any\ninstrument of transfer or other document used in the process of selling or\ntransferring same shall not exempt the person attempting t o transfer from penalties\nprovided or deprive the purchaser of any rights or remedies he may otherwise have.\nProvided, however, any person, or his agent, may agree to sell any lot or parcel of\nland located within a subdivision by reference to an unapproved  or unrecorded plat\nor by reference to a metes and bounds description of such lot and any such\nexecutory contract of sale or option to purchase may be recorded and shall be valid\nand enforceable so long as the subdivision of land contemplated therein is la wful\nand the subdivision plat subsequently receives final approval of the planning\ncommission.\n(4) Any street or other public ground which has been dedicated shall be accepted for\nmaintenance by the legislative body after it has received final plat approva l by the\nplanning commission. Any street that has been built in accordance with specific\nstandards set forth in subdivision regulations or by ordinance shall be, by operation\nof law, automatically accepted for maintenance by a legislative body forty -five (45)\ndays after inspection and final approval.\n(5) Any instrument of transfer, sale or contract that would otherwise have been void\nunder this section and under any of its subsections previously, is deemed not to have\nbeen void, but merely not subject to be  recorded unless the subdivision plat\nsubsequently receives final approval of the planning commission. This subsection\nshall not apply to instruments of transactions affecting property in counties\ncontaining cities of the first class, in consolidated local  governments created\npursuant to KRS Chapter 67C, or in urban -counties created pursuant to KRS\nChapter 67A.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26757","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:04Z","sha256":"baad70899350c7127ed06d09b707a6166691ecf8b4692bfe2f82abc61cdc184f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.275","next":"us-ky/krs-100.280"},"notice":"GroundRules: Original legal text.
