{"data":{"id":"us-ky/krs-100.281","jurisdiction":"us-ky","citation":"KRS 100.281","heading":"Contents of subdivision regulations.","body":"Subdivision regulations shall be based on the comprehensive plan, in those counties\nwhich have adopted a comprehensive plan, and all subdivision regulations shall contain:\n(1) The procedure for the submission and approval of preliminary and final plat and the\nrecordation of final plats. The commission may delegate to its secretary or any other\nofficer or employee the power to approve plats in accordance with the commission's\nadopted requirements, but all plats, preliminary and final, shall be approved or\ndisapproved within ninety (90) days;\n(2) Specifications for the contents and the format of all subdivision plats;\n(3) Requirements for the design of streets, blocks, lots, utilities, recreation areas, other\nfacilities, hazardous areas, and areas subject to f looding. Such requirements may\ndeal with all forms of land use including residential, commercial, industrial, and\nother uses. If the subdivision plat includes a proposal for any street to cross a\njurisdictional line out of the planning unit, the commission  shall require that notice\nof the proposal be given to the planning commission serving the planning unit into\nwhich the road will cross. If there is no planning unit for that area, the notice shall\nbe given to the affected city or county government;\n(4) Specifications for the physical improvements of streets, utilities, and other facilities,\nand the extent to which they shall be installed or dedicated as conditions precedent\nto approval of any plat, including the provision of good and sufficient surety to\ninsure proper completion of physical improvements; and\n(5) Specifications for the extent to which land is to be used for public purposes shall be\nreserved as a condition precedent to approval by the commission of any subdivision\nplat. The planning commissio n may require a reservation, not to exceed two (2)\nyears, for parks, open space, school, and other public uses.\n(6) The text may empower the planning commission to hear and finally decide\napplications for variances when a proposed development requires a su bdivision and\none (1) or more variances.\n(7) In any regulation adopted pursuant to subsection (6) of this section:\n(a) The text shall provide that the planning commission shall assume all powers\nand duties otherwise exercised by the board of adjustment pur suant to KRS\n100.231, 100.233, 100.237, 100.241, 100.243, 100.247, and 100.251 in a\ncircumstance provided for by subsection (6) of this section; and\n(b) The text shall provide that the applicant for the subdivision at the time of the\nfiling of the application for the subdivision may elect to have any variance for\nthe same development to be heard and finally decided by the planning\ncommission at the same public hearing set for the subdivision, or by the board\nof adjustment as otherwise provided for in this chapter.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26759","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:04Z","sha256":"580252ce813ea99c2e8a1c4cf567ec167af7fe9ac8404ef7839158af013051c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.280","next":"us-ky/krs-100.283"},"notice":"GroundRules: Original legal text.
