{"data":{"id":"us-ky/krs-100.326","jurisdiction":"us-ky","citation":"KRS 100.326","heading":"Definitions for section -- Retail filling stations -- Limitations on regulation","body":"by local government.\n(1) As used in this section:\n(a) \"Electric vehicle charging station\" has the same meaning as in KRS 138.477;\nand\n(b) \"Retail filling station\" has the same meaning as in KRS 138.210.\n(2) A city, county, urban -county government, charter county, or consolidated local\ngovernment shall not utilize a zoning process, or adopt or enforce an ordinance,\norder, regulation, or similar measure that:\n(a) Prohibits or limits a retail filling station from locating at any place within its\njurisdiction at which other businesses of similar uses or character which serve\nthe public may locate;\n(b) Could be reasonably construed to apply discriminatory treatment to th e use or\nlocation of retail filling stations; or\n(c) Treats retail filling stations differently than electric vehicle charging stations.\n(3) This section shall not prohibit a local jurisdiction identified in subsection (2) of this\nsection from subjecting r etail filling stations to restrictions similar to those\napplicable to other businesses that:\n(a) Provide siting requirements, including siting requirements involving certain\ngeographic areas;\n(b) Do not effectively prohibit the operation of a retail filling station; and\n(c) Are not preempted by state or federal law.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55536","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:04Z","sha256":"d607cba5755fe10d8e0e832037c83ef517631faac6ace340c4779619ee2c29fc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.325","next":"us-ky/krs-100.327"},"notice":"GroundRules: Original legal text.
