{"data":{"id":"us-ky/krs-100.346","jurisdiction":"us-ky","citation":"KRS 100.346","heading":"Orientation and continuing education training for planning and zoning","body":"officials and staff.\n(1) (a) Each planning commissioner and board of adjustment member of a planning\nunit shall, within one (1) year prior to his or her appointment and one ( 1) year\nfollowing appointment, attend a minimum of three (3) hours of orientation\ntraining in one (1) or more of the subjects listed in subsection (4) of this\nsection and at least one (1) additional hour of training on the impact of\nplanning and zoning pol icies and procedures on housing supply and\naccessibility.\n(b) Each planning professional, zoning administrator, and administrative official,\nand each planning professional's deputies and assistants, shall, within one (1)\nyear prior to being employed, or wi thin one hundred twenty (120) days of\nemployment, attend a minimum of seven (7) hours of orientation training in\none (1) or more of the subjects listed in subsection (4) of this section and at\nleast one (1) additional hour of training on the impact of plan ning and zoning\npolicies and procedures on housing supply and accessibility.\n(c) Each of the individuals listed in paragraphs (a) and (b) of this subsection shall\ncertify his or her attendance by a written statement filed with the secretary of\nhis or her r espective planning commission within thirty (30) days of\ncompleting the orientation training required in paragraphs (a) and (b) of this\nsubsection. Each statement shall identify the date of each program attended,\nits subject matter, location, sponsors, and the time spent in each program.\n(2) (a) Each planning commissioner and board of adjustment member of a planning\nunit shall, within each period of four (4) consecutive calendar years, starting\nat the date of the individual's appointment, attend no less tha n seven (7) hours\nof continuing education in any of the subjects listed in subsection (4) of this\nsection and at least one (1) additional hour of training on the impact of\nplanning and zoning policies and procedures on housing supply and\naccessibility.\n(b) Each planning professional, zoning administrator, and administrative official,\nand each planning professional's deputies and assistants, shall, within each\nperiod of two (2) consecutive calendar years, starting at the date of the\nindividual's appointment, attend no less than fifteen (15) hours of continuing\neducation in any of the subjects listed in subsection (4) of this section and at\nleast one (1) additional hour of training on the impact of planning and zoning\npolicies and procedures on housing supply and accessibility.\n(c) Each of the individuals listed in paragraphs (a) and (b) of this subsection shall\ncertify his or her attendance by a written statement filed with the secretary of\nhis or her respective planning commission within thirty (30) days of\ncompleting the continuing education required in paragraphs (a) and (b) of this\nsubsection. Each statement shall identify the date of each program attended,\nits subject matter, location, sponsors, and the time spent in each program.\n(3) The planning commissi on or the legislative body of the city, county, urban -county\ngovernment, charter county government, or consolidated local government in which\nthe planning commission has jurisdiction or, in the case of a joint planning unit, has\nrepresentation in, shall be  responsible for providing training as required by\nsubsections (1) and (2) of this section or for providing funding to each planning\ncommissioner, board of adjustment member, full -time planning professional,\nzoning administrator, administrative official, a nd planning professional's deputies\nor assistants so that each individual may obtain training as required by subsections\n(1) and (2) of this section from other sources.\n(4) The subjects for the education required by subsections (1) and (2) of this section\nshall include but not be limited to any of the following: land use planning; zoning;\nfloodplains; transportation; community facilities; ethics; public utilities; wireless\ntelecommunications facilities; parliamentary procedure; public hearing procedure;\nadministrative law; economic development; housing; public buildings; building\nconstruction; land subdivision; and powers and duties of the board of adjustment.\nOther topics reasonably related to the duties of planning officials or planning\nprofessionals may b e approved by majority vote of the planning commission prior\nto December 31 of the year for which credit is sought.\n(5) Each local planning commission shall keep in its official public records originals of\nall statements and the written documentation of attendance required in subsection\n(6) of this section filed with the secretary of the planning commission pursuant to\nsubsections (1)(c) and (2)(c) of this section for three (3) years after the calendar\nyear in which each statement and appurtenant written documentation is filed.\n(6) Each planning commissioner, board of adjustment member, full -time planning\nprofessional, zonin g administrator, administrative official, and planning\nprofessional's deputies or assistants shall be responsible for obtaining written\ndocumentation signed by a representative of the sponsor of any continuing\neducation course for which credit is claimed, acknowledging the fact that the\nindividual attended the program for which credit is claimed. That documentation\nshall be filed with the secretary of the planning commission as attachments to the\nstatements required by subsections (1)(c) and (2)(c) of this section.\n(7) If a planning commissioner or board of adjustment member fails to:\n(a) Complete the requisite number of hours of orientation training and continuing\neducation within the time allotted under subsections (1) and (2) of this\nsection;\n(b) File the statement required by subsections (1)(c) and (2)(c) of this section; or\n(c) File the documentation required by subsection (6) of this section;\nthe planning commissioner shall be subject to removal from office according to the\nprovisions of KRS 100.157, and the board of adjustment member shall be subject to\nremoval according to the provisions of KRS 100.217.\n(8) No city, county, urban -county government, charter county government,\nconsolidated local government, planning commission, board of adjustment, or a ny\nentity performing local planning under KRS Chapter 100, shall employ a planning\nprofessional, zoning administrator, administrative official, or a planning\nprofessional's deputy or assistant, who fails to complete the requisite number of\nhours of orientation and continuing education required by subsections (1) and (2) of\nthis section in the capacity of a planning professional, zoning administrator,\nadministrative official, or planning professional's deputy or assistant.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56262","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:05Z","sha256":"0d2b073246e9533a176f2c7a7d8d659e805e0b64693b4f7e99d5676275343b1e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.345","next":"us-ky/krs-100.347"},"notice":"GroundRules: Original legal text.
