{"data":{"id":"us-ky/krs-100.361","jurisdiction":"us-ky","citation":"KRS 100.361","heading":"Construction of chapter.","body":"(1) Nothing in this chapter shall apply or affect zoning regulations adopted pursuant to\nKRS Chapter 183.\n(2) Nothing in this chapter shall impair the sovereignty of the Commonwealth of\nKentucky over its political subdivisions. Any proposal affecting land use by any\ndepartment, commission, board, authority, agency, or instrumentality of state\ngovernment shall not require approval of the local planning unit. However, adequate\ninformation concerning the proposals shall be furnished to the planning commission\nby the department, commission, board, authority, agency, or instrumentality of state\ngovernment. If the state proposes to acquire, construct, alter, or lease any land or\nstructure to be used as a penal institution or correctional facility, and the proposed\nuse is inconsistent with or contrary to local planning regulations or the\ncomprehensive plan for the area, the secretary of the Justice and Public Safety\nCabinet, or his or her designee, shall notify, in accordance with KRS 424.180, the\nplanning commission, t he local governing body who has jurisdiction over the area\ninvolved, and the general public of the state's proposals for the area, and he or she\nshall hold a public hearing on the proposals within the area at least ninety (90) days\nprior to commencing the acquisition, construction, alteration, or leasing. A final\nreport on the public hearing shall be submitted to the Governor and members of the\nGeneral Assembly within twenty -five (25) days of the public hearing, and prior to\ncommencing any construction, alteration, acquisition, or leasing of such property or\nfacilities.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26803","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:05Z","sha256":"3671d0ec3d116ebe1d7ee17b55b4e3bb05735317528ff4c0404afb40fae7dade","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.360","next":"us-ky/krs-100.362"},"notice":"GroundRules: Original legal text.
