{"data":{"id":"us-ky/krs-100.403","jurisdiction":"us-ky","citation":"KRS 100.403","heading":"Definitions for KRS 100.401 to 100.419.","body":"As used in KRS 100.401 to 100.419, unless the context otherwise requires:\n(1) \"Land use enforcement officer\" in a county containing a consolidated local\ngovernment means an officer authorized by a planning commission to enforce\nbinding elements.\n(2) \"Land use ordinance\" in a county containing a consolidated local government means\nan official action of a local government body which is a regulation of a general and\npermanent nature relating to the use and development of land within the\njurisdictional boundary of the planning commission. It is enforceable as a local law\nand shall include any provision of a code of ordinances adopted by a local\ngovernment which embodies all or part of an ordinance.\n(3) \"Local government\" means a county containing a consolidated local government\nand all cities with a population equal to or greater than three thousand (3,000) or\nany city with a population of less than three thousand (3,000) based upon the most\nrecent federal decennial census that regulated land use under the provis ions of this\nchapter prior to January 1, 2014, within the county.\n(4) \"Binding element\" in a county containing a consolidated local government means a\nbinding requirement, provision, restriction, or condition imposed by a planning\ncommission or its designe e, or a promise or agreement made by an applicant in\nwriting in connection with the approval of a land use development plan or\nsubdivision plan.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43783","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:05Z","sha256":"4105301dc9c33c2d8f02141160de37a942fc6f5e7e36823a52e813f3f46abece","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.401","next":"us-ky/krs-100.405"},"notice":"GroundRules: Original legal text.
