{"data":{"id":"us-ky/krs-100.405","jurisdiction":"us-ky","citation":"KRS 100.405","heading":"Enforcement of binding elements classified as civil offenses -- Exception to","body":"powers of classification.\n(1) The planning commission in counties containing a consolidated local government\nmay issue remedial orders and impose civil fines as a method of enforcing a binding\nelement when a violation of that binding element has been classified as a civil\noffense in accordance with this section.\n(2) Subject to the limitations set forth in subsections (1) and (3) of this section, if a\nlocal government elects to enforce a binding element as a civil offense, it shall do so\nby ordinance, which shall provide:\n(a) That a violation of the binding element is a civil offense; and\n(b) A maximum civil fine that may be imposed for each violation of a binding\nelement.\n(3) No local government shall classify the violation of a binding element as a civil\noffense if the violation would also constitute an offense under any provision of the\nKentucky Revised Statutes, including specifically and without limitation any\nprovision of the Kentucky Penal Code and any moving motor vehicle offense.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43784","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:05Z","sha256":"b7ef696ec7d0b5edaccb7dbf6b194a60a33294f97311fe2b41275c64c39eac0a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.403","next":"us-ky/krs-100.407"},"notice":"GroundRules: Original legal text.
