{"data":{"id":"us-ky/krs-100.413","jurisdiction":"us-ky","citation":"KRS 100.413","heading":"Appeals from final order of planning commission and judgment of District","body":"Court.\n(1) An appeal from any final order issued by a planning commission may be made to\nthe District Court of the county in which the planning commission is located. The\nappeal shall be taken within thirty (30) days of the date the order is issued. The\nappeal shall be initiated by the filing of a complaint and a copy of the commission's\norder in the same manner as any civil action under the Rules of Civil Procedure.\nThe action sh all be tried de novo and the burden shall be upon the planning\ncommission to establish that a violation has occurred. If the court finds that a\nviolation occurred, judgment shall be entered ordering the offender to pay to the\nplanning commission all fines assessed for the violation. If the court finds a\nviolation did not occur, the complaint shall be dismissed.\n(2) A judgment of the District Court may be appealed to the Circuit Court in\naccordance with the Rules of Civil Procedure.\n(3) If no appeal from a f inal order of a planning commission is filed within the time\nperiod set forth in this section, the planning commission's order shall be deemed\nfinal for all purposes.","path":["KRS Chapter 100"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26823","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:05Z","sha256":"3ab3b5e9506bada328647434a36941d0556eb8db8a1730a256c2887355983cc6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-100.411","next":"us-ky/krs-100.415"},"notice":"GroundRules: Original legal text.
