{"data":{"id":"us-ky/krs-103.200","jurisdiction":"us-ky","citation":"KRS 103.200","heading":"Definitions for KRS 103.200 to 103.285.","body":"As used in KRS 103.200 to 103.285:\n(1) \"Building\" or \"industrial building\" means any land and building or buildings,\nincluding office space related and subordinate to any of the facilities enumerated in\nthis subsection, any facility or other improvement thereon, and all real and personal\nproperties, including operating equipment and machinery deemed necessary in\nconnection therewith, whether or not now in existence, which shall be suitable for\nthe following or any combination thereof:\n(a) Any activity, business, or industry for the manufacturing , processing or\nassembling of any commercial product, including agricultural, mining, or\nmanufactured products and solar -generated electricity, together with storage,\nwarehousing, and distribution facilities in respect thereof;\n(b) Any undertaking involvin g the construction, reconstruction, and use of\nairports, mass commuting facilities, ship canals, ports or port facilities, docks\nor wharf facilities or harbor facilities, off -street parking facilities or of\nrailroads, monorails, or tramways, railway or air line terminals, cable\ntelevision, mass communication facilities, and related facilities;\n(c) Any buildings, structures, and facilities, including the site thereof and\nmachinery, equipment, and furnishings suitable for use as health -care or\nrelated faciliti es, including without limitation hospitals, clinics, nursing\nhomes, research facilities, extended or long -term care facilities, including\nhousing for the aged or the infirm and all buildings, structures, and facilities\ndeemed necessary or useful in connection therewith;\n(d) Any nonprofit educational institution in any manner related to or in\nfurtherance of the educational purposes of such institution, including but not\nlimited to classroom, laboratory, housing, administrative, physical\neducational, and medical research and treatment facilities;\n(e) Any facilities for any recreation or amusement park, public park, or theme\npark, including specifically facilities for the use of nonprofit entities in\nmaking recreational and cultural benefits available to the public;\n(f) Any facilities involving manufacturing and service industries which process\nraw agricultural products, including timber, provide value -added functions, or\nsupply ingredients used for production of basic agricultural crops and\nproducts;\n(g) Any facilities incident to the development of industrial sites, including land\ncosts and the costs of site improvements thereon, such as grading, streets,\ndrainage, storm and sanitary sewers, and other facilities and structures\nincidental to the use of such site or sites for industrial use;\n(h) Any facilities for the furnishing of water, if available on reasonable demand to\nmembers of the general public;\n(i) Any facilities for the extraction, production, grading, separating, washing,\ndrying, preparing, sorting, loading, and distribution of mineral resources,\ntogether with related facilities;\n(j) Any convention or trade show facilities, together with all relate d and\nsubordinate facilities necessary to the development and proper utilization\nthereof;\n(k) Any facilities designed and constructed to be used as hotels or motels,\ntogether with all related and subordinate facilities necessary to the operation\nthereof, including site preparation and similar facilities;\n(l) Any activity designed for the preservation of residential neighborhoods,\nprovided that such activity receives approval of the heritage division and\ninsures the preservation of not fewer than four (4) family units;\n(m) Any activity designed for the preservation of commercial or residential\nbuildings which are on the National Register of Historic Places or within an\narea designated as a national historic district or approved by the heritage\ndivision;\n(n) Any activity, including new construction, designed for revitalization or\nredevelopment of downtown business districts as designated by the issuer;\n(o) Any use by an entity recognized by the Internal Revenue Service as an\norganization described in 26 U.S.C. sec. 501(c)(3) in any manner related to or\nin the furtherance of that entity's exempt purposes where the use would also\nqualify for federally tax -exempt financing under the rules applicable to a\nqualified 501(c)(3) bond as defined in 26 U.S.C. sec. 145; and\n(p) Any activity, including new construction, that would result in an increase of\nforty-eight (48) units or more to the stock of residential multifamily housing\nunits;\n(2) \"Bonds\" or \"negotiable bonds\" means bonds, notes, variable rate bonds, commercial\npaper bonds, bond anticipation notes, or any other obligations for the payment of\nmoney issued by a city, county, or other authority pursuant to KRS 103.210 to\n103.285; and\n(3) \"Substantiating documentation\" means an independent finding, study, report, or\nassessment of the economic and financial impact of a project, which shall include a\nreview of customary business practices, terms, and conditions for similar types of\nprojects, both taxable and tax-exempt, in the current market environment.","path":["KRS Chapter 103"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55985","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:07Z","sha256":"364a51b3f51ecb886f6f5f1005bf65486db682f42f7b2f6740aa823ff4c6c78e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-103.195","next":"us-ky/krs-103.210"},"notice":"GroundRules: Original legal text.
