{"data":{"id":"us-ky/krs-103.282","jurisdiction":"us-ky","citation":"KRS 103.282","heading":"Issuance of bonds to assist small or medium -sized manufacturers with","body":"energy efficiency projects through guaranteed energy savings contracts.\n(1) As used in this section:\n(a) \"Energy service company\" means an entity in the business of providing\nevaluation, design, implementation, installation, measurement and\nverification, and other related services under guaranteed energy savings\ncontracts;\n(b) \"Guaranteed energy savings contract\" means a contract for the evaluation and\nrecommendation of energy, water, and wastewater conservation measures and\nfor implementation of one (1) or more of those measures. The contract may\nprovide that payments, except obligations on termination of the contract\nbefore its expiration, are to be made over time and shall provide t hat the\nsavings are guaranteed to the extent necessary to make payments for the cost\nof the design, installation, and maintenance of energy, water, and wastewater\nconservation measures; and\n(c) \"Small or medium -sized manufacturer\" means any existing busine ss entity\norganized for profit that is operating an industrial building used as a\nmanufacturing facility in the Commonwealth, and that has three hundred (300)\nor fewer full-time employees located at that manufacturing facility at the time\nbonds are to be issued pursuant to this section.\n(2) In order to further the purposes stated in KRS 103.210 and to advance the\nCommonwealth's goals of achieving a greater proportion of its energy needs\nthrough increased efficiency and conservation in the private sector, bo nds may be\nissued by any city, county, air board, riverport authority, or the Kentucky Economic\nDevelopment Finance Authority to assist a small or medium -sized manufacturer\nwith developing or improving its manufacturing facilities through the use of a\nguaranteed energy savings contract to increase the energy efficiency thereof.\n(3) Bonds shall only be issued pursuant to this section if:\n(a) The energy efficiency project being undertaken through the guaranteed energy\nsavings contract is to be performed by a qualified provider as defined in KRS\n45A.345; and\n(b) The energy service company provides a guarantee that the project will achieve\na reduction in energy consumption:\n1. That is measurable and verifiable; and\n2.
