{"data":{"id":"us-ky/krs-104.520","jurisdiction":"us-ky","citation":"KRS 104.520","heading":"Boundaries of district -- Determination of -- When cities with population of","body":"8,000 or more may be included.\n(1) When the petition is filed with the secretary, he shall investigate at once the\nboundary of the district proposed to be organized, and ma y, at the cost of the\npetitioners, cause to be made surveys necessary to establish with reasonable\naccuracy a boundary that will, in his judgment, accomplish the purpose sought by\nthe creation of the district in a practicable and workable manner, and that will be\nsufficiently comprehensive to avoid confusion or interference with any other similar\ndistrict then existing or that may be created. The boundary established by the\nsecretary need not follow the boundary proposed by the petitioners, but if the\nboundary established by the secretary results in a material change from that\nproposed in the original petition the petitioners shall secure, in case of a larger or\nsmaller area, the signatures of seventy percent (70%) of the freeholders or owners in\nthe area as established by the secretary.\n(2) Should it be found desirable to include in a flood control district all or a portion of a\ncity with a population equal to or greater than eight thousand (8,000) based upon the\nmost recent federal decennial census, the gov erning body of such city shall\ndetermine by ordinance whether the city or portion thereof shall be included in the\ndistrict, or whether the city shall bind itself to pay the taxes levied for the benefits of\nthe district in such area.","path":["KRS Chapter 104"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43786","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:08Z","sha256":"b262fc4e9e12da7f9ff1e537c80ea5794344aa64e54a55447725d7933239e358","source_id":"us-ky","stale":false,"prev":"us-ky/krs-104.510","next":"us-ky/krs-104.530"},"notice":"GroundRules: Original legal text.
