{"data":{"id":"us-ky/krs-104.550","jurisdiction":"us-ky","citation":"KRS 104.550","heading":"Certificate of establishment of district -- Issuance -- Filing -- General","body":"powers of district.\nIf no suit is filed against the secretary under KRS 104.540, or if suit is filed and final\njudgment in the Circuit Court or on appeal is in favor of the secr etary, the secretary shall\nforthwith declare the district organized into a flood control district and give it a corporate\nname as provided in KRS 104.490, by which in all proceedings it shall thereafter be\nknown. The secretary shall certify his act to the county clerk of each county in which any\npart of the district is located, and to the Secretary of State, each of whom shall record the\ncertificate as articles of incorporation. The secretary shall also certify his act to the county\njudge/executive of each county in which any part of the district is located. The district\nshall then be a political subdivision and shall have perpetual existence, with power to sue\nand be sued, contract and be contracted with, incur liabilities and obligations, exercise the\nright of eminent domain, assess, tax, issue bonds, and do and perform all acts expressly\nauthorized in KRS 104.450 to 104.680 and all acts necessary and proper for the carrying\nout of the purpose for which the district was created, and for executing the powers  with\nwhich it is invested.","path":["KRS Chapter 104"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27093","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:08Z","sha256":"88c2ddfa9adf9b617a4eb842bcf41cfade3962b1f95e07c26ab31a462ff70d2a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-104.540","next":"us-ky/krs-104.560"},"notice":"GroundRules: Original legal text.
