{"data":{"id":"us-ky/krs-104.580","jurisdiction":"us-ky","citation":"KRS 104.580","heading":"Board of directors -- Appointment -- Qualifications -- Term -- Vacancies --","body":"Removal of board members.\n(1) Within thirty (30) days after the secretary certifies to the county clerk of each county\nin which the district is located that the district is incorporated, there shall be\nappointed a board of directors for the district, consisting of five (5) members, which\nshall control and manage the affairs of the district. If all or part of a city with a\npopulation equal to or greater than eight thousand (8, 000) based upon the most\nrecent federal decennial census lies within the district, the mayor of such city shall\nappoint three (3) members of the board of directors, and the county judge/executive\nshall appoint two (2) members, or if the district lies withi n two (2) counties, each\ncounty judge/executive shall appoint one (1) member, or if the district lies within\nmore than two (2) counties, the county judge/executive of each of two (2) of the\ncounties, in rotation as determined by lot, shall appoint one (1) member. If all or\npart of two (2) cities with a population equal to or greater than eight thousand\n(8,000) based upon the most recent federal decennial census lies within the district\nthe mayor of each city shall each appoint two (2) members of the board of directors,\nand the fifth member shall be appointed by the county judge/executive of the county\nin which the major portion of the district lies. If all or part of more than two (2)\ncities with a population equal to or greater than eight thousand (8,000) b ased upon\nthe most recent federal decennial census lies within the district the mayor of each\ncity shall appoint one (1) member of the board and one (1) additional member shall\nbe appointed by each mayor of the city or cities containing most of the distric t to\nmake the full number of five (5) directors. If no city with a population equal to or\ngreater than eight thousand (8,000) based upon the most recent federal decennial\ncensus, or part thereof, lies within the district, the county judge/executive shall\nappoint all five (5) members, or if the district lies in two (2) counties, the county\njudge/executive of the county in which the major portion of the district is located\nshall appoint three (3) members and the county judge/executive of the other county\nshall appoint two (2) members, or if the district lies in more than two (2) counties,\nthe county judge/executive of each county shall appoint one (1) member and one (1)\nadditional member shall be appointed by each county judge/executive of the county\nor counti es containing most of the district to make the full number of five (5)\ndirectors. No director shall in any way be associated or connected with the\nownership, operation or control of any privately -owned public utility operating\nwithin the district. Two (2) of the members of the first board of directors shall hold\ntheir offices for one (1) year, and the others shall hold their offices for two (2), three\n(3) and four (4) years, respectively, from the dates of their appointments, the length\nof the term of offic e of each member to be determined by lot at their first meeting.\nAfter the expiration of the respective terms of office of the members of the first\nboard of directors, each director shall be appointed and shall serve for a period of\nfour (4) years and unti l his successor has been appointed and has qualified.\nVacancies resulting from any cause other than expiration of a term of office shall be\nfilled only for the unexpired term and until a successor has been appointed and has\nqualified. The directors shall a t all times be residents and real estate owners within\nthe district, and the office of any director who moves his residence outside the\ndistrict or who ceases to be a real estate owner within the district shall automatically\nbe vacated.\n(2) (a) All appointments by a county judge/executive pursuant to this section shall be\nwith the approval of the fiscal court.\n(b) A member of the board of directors may be removed from office as provided\nby KRS 65.007.","path":["KRS Chapter 104"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43787","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:08Z","sha256":"ddbc27007785bfd09d77a09436bd63afa7d8cd8f7da63eece1a7a3289d8bb45b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-104.570","next":"us-ky/krs-104.590"},"notice":"GroundRules: Original legal text.
