{"data":{"id":"us-ky/krs-104.610","jurisdiction":"us-ky","citation":"KRS 104.610","heading":"Officers and employees of board -- Seal -- Records -- Expenses -- Rules and","body":"regulations -- Civil liabilities -- Audits -- Compliance with KRS 65A.010 to\n65A.090.\n(1) The board of directors shall, upon taking oath, elect one (1) of their members as\npresident of the board, and shall select some suitable person as secretary, who need\nnot be a member of the board. The secretary shall serve as treasurer of the district,\nor the board may select a treasurer. The selection of the secretary and treasurer shall\nbe evidenced on the minutes of the board, with their compensation. He or they shall\nserve at the pleasure of the board.\n(2) The board shall adopt a seal, and shall keep in a well -bound book a record of all\nproceedings, minutes of meetings, certificates, contracts, bonds given by employees,\nand all corporate acts, which shall be open to the inspection of any owner of\nproperty in the district as well as all other interested persons.\n(3) The board of directors shall be the governing body of the flood control d istrict, and\nshall exercise all the powers and manage and control all of the affairs and property\nof the district.\n(4) No compensation shall be paid to directors, but each director shall be reimbursed\nfor expenses incurred in attending meetings or for expe nses incurred in other\nactivities authorized by the board of directors as necessary for carrying out the\npurposes of the flood control district.\n(5) The board of directors may adopt all necessary rules and regulations for the proper\nmanagement and conduct of the business of the board and of the corporation, and\nfor carrying into effect the other objects for which the district was formed. The\nboard of directors may also make and enforce rules and regulations pertaining to the\nuse by persons of land or proper ties connected with or a part of the flood control\nworks. All such rules and regulations shall become effective on the date when a\nnotice of their adoption is published pursuant to KRS Chapter 424; such notice shall\nnot contain the rules and regulations in  full but shall only summarize their contents\nand shall state where any interested person may examine the full texts of such rules\nand regulations.\n(6) The board of directors may recover by civil action from any person or public\ncorporation violating such rules and regulations a sum not less than one hundred\ndollars ($100) nor more than one thousand dollars ($1,000), together with costs.\nThe board may enforce by mandamus or otherwise all necessary and authorized\nrules and regulations made by it, and may tak e summary action to remove any\nimproper construction or to terminate any unauthorized practices in connection with\nflood control works. Any person or public corporation willfully failing to comply\nwith rules and regulations of the board shall be liable for  damages caused by such\nfailure and for the cost of renewing or replacing any part of the flood control works\ndamaged or destroyed.\n(7) The board of directors shall have an annual audit made by a certified public\naccountant, copies of which shall be filed with the Secretary of State and with the\ncounty judge/executive of the county or counties in which the flood control district\nis located.\n(8) The board of directors shall comply with the provisions of KRS 65A.010 to\n65A.090.","path":["KRS Chapter 104"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41729","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:08Z","sha256":"05a9d1b0db94e0844ee7333f301ab72c460c1792368b909267b9e55277ea0f8e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-104.600","next":"us-ky/krs-104.620"},"notice":"GroundRules: Original legal text.
