{"data":{"id":"us-ky/krs-106.220","jurisdiction":"us-ky","citation":"KRS 106.220","heading":"Power of eminent domain.","body":"(1) Any water district or municipality referred to herein shall have the right to acquire\nby exercise of the power of eminent domain all lands, easements, rights of way,\neither upon or under or above the ground, any existing water plant or water\ndistribution s ystem and appurtenances thereto, or any part of same, within the\nboundaries or corporate limits of such water district or city, and any and all real\nestate, franchises or personal property reasonably necessary or desirable in\nconnection with the constructi on or operation or maintenance of water plants or\nwater distribution systems, or improvements or extensions thereto, and the right to\nacquire same is hereby declared to be a superior and paramount right, superior and\nparamount to any other public use, and further provided that as in the eminent\ndomain proceedings to acquire from any public or private utility a water plant or\nwater distribution system the property condemned must include all the property\nowned by the utility within the corporate limits of the  said water district or the city\nwhich is used or useful in connection with the business of providing water service.\n(2) The condemnation or eminent domain proceedings shall be brought in the name of\nthe water district or in the name of the municipality, a nd title to the property so\ncondemned shall be taken in the name of the water district or municipality as the\ncase may be.","path":["KRS Chapter 106"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27146","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:09Z","sha256":"3cdd40c80f41fad6222b8df9b95d1e4790e3935fe78b2bfd599377bae709a3f8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-106.210","next":"us-ky/krs-106.230"},"notice":"GroundRules: Original legal text.
