{"data":{"id":"us-ky/krs-107.050","jurisdiction":"us-ky","citation":"KRS 107.050","heading":"Procedure following public hearing -- Second ordinance.","body":"(1) At a subsequent regular meeting of the governing body, the said written report of\nsaid public hearing shall be publicly received, read, and considered by the\ngoverning body of the city. At such meeting, or at any subsequent properly\nconvened regular, adjou rned or special meeting, owners of properties to be\nbenefited may again be heard, in person or by a representative, and the governing\nbody may adopt an ordinance (hereinafter referred to as the \"Second Ordinance\"),\nwhich may provide for (a) abandonment of the project, or (b) the undertaking of the\nproposed project, with provision for the financing thereof according to the \"assessed\nvalue basis\" set forth in this chapter, or (c) the undertaking of the project, with\nprovision for the financing thereof accordi ng to any other method which may be\npermitted by law, or (d) altering the nature and scope of the proposed project, in\nwhich event the procedure for public hearing and a further report shall be repeated\naccording to the preceding provisions of this chapter . If the governing body shall\ndetermine that the owners of more than fifty percent (50%), both in number of lots\nor parcels and in aggregate assessed value of the properties to be benefited by the\nproject, object to the financing thereof through annual ass essments levied upon the\n\"assessed value basis,\" as authorized in this chapter, the governing body may enact\nthe second ordinance only upon the affirmative vote of members constituting not\nless than three -fifths (3/5) of the membership of the governing bod y, the names of\nthe members so voting to be recorded in the minutes of the meeting whether or not\nthere be any other requirement of such procedure in any other law applicable to the\nclass of city in question. The second ordinance shall be published as prov ided in\nthis chapter with respect to publication of the first ordinance.\n(2) Before the second ordinance for a wastewater collection project adopted by the\nboard of a metropolitan sewer district shall become effective, the following shall\ntake place: (a) if the benefited property is situated outside a city of the first class, the\nsecond ordinance shall also be adopted by appropriate ordinance or resolution of the\nfiscal court of the county in which the district is situated, or (b) if the benefited\nproperty is situated within a city of the first class, the second ordinance shall be\nadopted by an appropriate ordinance of the board of aldermen of that city.","path":["KRS Chapter 107"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27157","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:09Z","sha256":"2644a7400c3203ea12b86aabfe607716943c6a802e3c1887fad0400a7609b419","source_id":"us-ky","stale":false,"prev":"us-ky/krs-107.040","next":"us-ky/krs-107.060"},"notice":"GroundRules: Original legal text.
