{"data":{"id":"us-ky/krs-107.190","jurisdiction":"us-ky","citation":"KRS 107.190","heading":"Action by city where ordinances and proceedings encompass less than all","body":"the undertakings contemplated by KRS 107.020, where all are encompassed\nand city undertakes additional improvements.\n(1) If the ordinances and proceedings authorized by thi s chapter shall encompass and\ninclude less than all of the undertakings authorized and contemplated by the\ndefinitions set forth in KRS 107.020, (i.e., a street improvement project with or\nwithout sidewalk, curb, gutter, and/or storm or surface water sewer s or drains or\nsanitary sewers, or sewage treatment facilities or fire hydrant in a city), the city shall\nnot be precluded from ordaining and requiring the omitted matters and structures to\nbe constructed at the expense of the benefited properties at any time in the future, in\naccordance with the provisions of this chapter, or in accordance with any other\napplicable laws.\n(2) If the improvement project shall encompass all of the elements included in the\ndefinition of \"improvement\" or \"project\" as set forth in this chapter, the city shall\nnot thereafter undertake any project for any part of the improvements as herein\ndefined, except:\n(a) At the exclusive cost of the city;\n(b) At the cost of the benefited properties from and after fifteen (15) years after\ncompletion and acceptance of the project; or\n(c) From the proceeds of revenue bonds payable from service charges.","path":["KRS Chapter 107"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48692","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:09Z","sha256":"6b3e9c318e75b52092a5aa09d76ddccb544c50957a7962c2dadde2c67b729796","source_id":"us-ky","stale":false,"prev":"us-ky/krs-107.180","next":"us-ky/krs-107.200"},"notice":"GroundRules: Original legal text.
