{"data":{"id":"us-ky/krs-107.720","jurisdiction":"us-ky","citation":"KRS 107.720","heading":"Privatization contracts -- Notice -- Hearing -- Competitive bidding --","body":"Assignment of contract.\n(1) Any political subdivision may enter into a privatization contract with a private\nowner or private owner/operator to accomplish the transfer of any polit ical\nsubdivision owned drinking water, water or wastewater project or the designing,\nconstruction, operation, maintenance, financing of cost or any combination thereof,\nof a drinking water, water or wastewater project pursuant to the provisions of KRS\n107.720 to 107.760.\n(2) Prior to a political subdivision entering into a privatization contract pertaining to its\ndrinking water, water or wastewater project, or any portion thereof, the governing\nauthority shall cause notice of its intention to adopt an ordin ance to accomplish\nsuch privatization to be published pursuant to KRS Chapter 424. The notice shall\nset forth a brief summary of the privatization contract provisions, and set a time and\nplace for a public hearing to be conducted by the executive authority of the political\nsubdivision. The notice shall be published each week for a period of two (2) weeks,\nthe first publication being not less than thirty (30) days prior to the adoption of the\nordinance approving the execution of the privatization contract. The hearing may be\nheld in conjunction with any hearing on the question of issuing bonds to finance the\ncost of the privatization project, or on the question of adoption of the service\nagreement, or any other question. A copy of the proposed privatization c ontract\nshall be filed as a public record with the clerk of the political subdivision not less\nthan thirty (30) days prior to the adoption of the aforesaid ordinance.\n(3) Notwithstanding whether the political subdivision has adopted the provisions of\nKRS 45A.345 to 45A.460, the privatization contract, the service agreement or any\nother purchase by the local government in connection with a privatization contract\nunder KRS 107.720 to 107.760 may be made or awarded by competitive bidding,\ncompetitive negotiation, or negotiation.\n(4) The privatization contract or the service agreement may be assigned by either party\nto secure the performance of any obligation in connection with the financing of\nconstruction or operation of a drinking water, water or wastewater project.","path":["KRS Chapter 107"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27202","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:10Z","sha256":"7c263d16d4e9cb30e123505aff59efe09160734ddcba066f6a20dfdb507f153a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-107.710","next":"us-ky/krs-107.730"},"notice":"GroundRules: Original legal text.
