{"data":{"id":"us-ky/krs-107.740","jurisdiction":"us-ky","citation":"KRS 107.740","heading":"Recall of ordinance creating privatization project.","body":"(1) Any ordinance creating a privatization project pursuant to KRS 107.720 to 107.760,\nwhich provides for the transfer of ownership of an existing publicly -owned facility\nto a private owner or private owner/operator, shall be subject to being recalled\npursuant to the public question procedure set out in KRS 83A.120, except that such\nrecall procedure shall not apply to an expansion of an existing facility. Upon the\nreceipt of a petition requesting recall, the ordinance shall be suspended from going\ninto effect pending the result of the election. If a majority of the votes cast upon the\nquestion is in the negative the ordinance shall not go into effect.
