{"data":{"id":"us-ky/krs-109.0415","jurisdiction":"us-ky","citation":"KRS 109.0415","heading":"Election on initial county solid waste management plan for counties","body":"without approved plan as of March 15, 1992.\n(1) As to any county for which an initial county or area solid waste management plan\nwas not approved by the cabinet as of March 15, 1992,  a county solid waste\nmanagement plan submitted to the cabinet shall not become effective if fifty -one\npercent (51%) of the registered voters eligible to vote in the last Presidential\nelection sign and file a petition with the county clerk and the cabinet requesting\nsubmission of the plan to voter approval. The petition shall be filed within one\nhundred fifty (150) days of the fiscal court vote approving the plan.\n(2) If the county clerk determines that the petition is in proper order, the clerk shall\ncertify the petition to the fiscal court. The fiscal court shall direct that the question\nbe placed before the voters at a special election held less than sixty (60) days from\nthe certification of the petition. The fiscal court shall bear the costs of advertisi ng\nand placing the question before the voters.\n(3) The county clerk shall advertise the question as provided in KRS Chapter 424 and\nshall instruct the voters to vote \"yes\" or \"no\" on acceptance of the solid waste\nmanagement plan. The results of the vote sh all be certified to the fiscal court of the\ncounty and the cabinet. The cabinet shall not approve a county solid waste\nmanagement plan if at least sixty (60) percent of those voting vote \"no.\"\n(4) The provisions of this section shall not apply to any subse quent plan submitted by\nany county.","path":["KRS Chapter 109"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27254","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:10Z","sha256":"02d989a02c53e293cdbaeede27b556af24998d3145c06a8a5a5bb7def898cde2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-109.041","next":"us-ky/krs-109.0417"},"notice":"GroundRules: Original legal text.
