{"data":{"id":"us-ky/krs-109.065","jurisdiction":"us-ky","citation":"KRS 109.065","heading":"Solid waste management facilities -- Prohibitions on county or waste","body":"management district where waste was generated -- Exemption.\n(1) Notwithstanding any provision of law to the contrary, except as provided in\nsubsection (2) of this section, a sol id waste management facility that is collecting,\nstoring, transporting, transferring, processing, treating, or disposing of solid waste\nthat was generated outside of the county or waste management district where the\nsolid waste management facility is locat ed shall not be subject to any assessment,\nfee, permitting requirement, or other authorization requirement imposed by the\ncounty or waste management district where the solid waste was generated.\n(2) Subsection (1) of this section shall not apply to conside ration or fees mutually\nagreed to in a franchise agreement specifically authorized by a county ordinance\nbetween a service provider and a county or waste management district for provision\nof solid waste collection, storage, transportation, transfer, proces sing, treatment, or\ndisposal services.","path":["KRS Chapter 109"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56835","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:11Z","sha256":"df17d34c020783fde6dcab8066dce507a2f470dd8849fd1081a25bc82e799847","source_id":"us-ky","stale":false,"prev":"us-ky/krs-109.062","next":"us-ky/krs-109.070"},"notice":"GroundRules: Original legal text.
